Presidential Address, "Political Self-Sufficiency", Tasks for the PMR Prosecutor's Office (Transcript)
29 Jan., 2026, 17:45In the area of prosecutorial oversight and control: Intensify efforts to coordinate cooperation between law enforcement agencies to protect public order, uphold the law, and protect citizens' rights and freedoms across a wide range of issues. Invite representatives of judicial authorities as necessary.
Monitor compliance with legal requirements during pre-trial investigations and criminal investigations, including tax crimes, as well as compliance with the law in the interaction between tax and law enforcement agencies when exchanging information on identified tax violations for the purpose of preventing tax offenses or crimes.
Systematically monitor compliance with the law during operational investigative activities to detect, prevent, and solve crimes. This is an important element of oversight. I am addressing the operational services. Dear investigators, any evidence obtained illegally, that is, without the appropriate sanction of either the prosecutor or the court, is deemed unlawful, and you, gentlemen, will be deemed to have exceeded your official authority. Therefore, everything must be documented and approved. Only then will the evidence you obtain form the basis of any criminal case. This should be clear.
Check compliance with the requirements of the "Law on Social Services for Elderly Citizens and Persons with Disabilities" in the republic, and also inspect correctional institutions for compliance with the law.
Check compliance with the requirements of the Law of December 8, 2003, "On Appeals from Citizens and Legal Entities, as well as Public Associations", including the personal participation of heads of state authorities and administrative bodies in reviewing appeals, as well as the monitoring by these bodies of the status of appeals in their subordinate institutions. I have already stated this. This applies to everyone, from the President to any official. If a complaint is specifically addressed to us, we bear personal responsibility for it. The President is no exception. This applies to everyone. For example, if it's written against Ivanov, Ivanov must sign the resolution, no one else. Under no circumstances should this complaint be dismissed as being outside your jurisdiction. It can be redirected, but you, the ones to whom it was written will be in charge. This is a matter of principle.
The Supreme Court and the Prosecutor's Office must take measures to ensure compliance with Articles 6-7 of the Criminal Procedure Code regarding a reasonable time for criminal proceedings. As for reasonable time, experts will understand.
So, we approach a mechanism that should work, but it's very poorly functioning, stalling with constantly emerging issues. What to do with an acquittal? Well, it would seem that everything is very simple. When rendering an acquittal, the court is clearly guided by both the Constitution and the laws. There are several options here. There are cases where the defendant wasn't deprived of liberty during the preliminary investigation or trial. Sometimes, they were. Naturally, a citizen has the right to compensation for being unlawfully imprisoned. What's going on? The government is listening attentively; that's your job. Who is the defendant? The Ministry of Finance? No. Esteemed court, the Ministry of Finance cannot be the defendant. They are the payers, the mechanism for organizing these payments. Who is the defendant? So, the court should ask who the defendant is. Perhaps the court should issue a special ruling and indicate what led to the acquittal: the shortcomings of the operational team, the inquiry, the investigation, the prosecutor's office, or all of them combined. Who should pay? The state, represented by the Ministry of Finance, pays. Someone should be held accountable for the acquittal, for improperly investigating and improperly documenting the results of the investigative operations, which resulted in the acquittal. Therefore, dear Anatoly Anatolyevich Guretsky, Adrian Mikhailovich Penkovsky, the Minister of Justice, and others, please hold a meeting. Vitaly Nikolayevich Neagu, you will be responsible for this area, in terms of developing a proper mechanism for holding a specific official accountable for an acquittal. This official should pay, and in no case should the defendant, which the Ministry of Finance supposedly is. The Ministry of Finance, I repeat, is a mechanism, not a defendant in this regard. We must begin with a specific ruling, which the court must issue for each acquittal. Conclusions must be drawn based on that. There is no other way. Therefore, conduct the necessary measures. If necessary, invite me, but I think you should work on this yourself first.
